These terms govern your use of the IGNYX application and this website. By using IGNYX you agree to them.
1. Who we are

2. What IGNYX provides
IGNYX is a wildfire incident command and decision-support application. It aggregates public data, performs calculations, and records information you enter.
IGNYX is decision support only. It is not a substitute for trained incident command. Please read the safety disclaimer — it forms part of these terms.
3. Your account and your organisation
You are responsible for the accuracy of what you enter, for keeping access credentials secure, and for the conduct of users within your organisation.
If you deploy IGNYX across an organisation, you are responsible for ensuring your people are trained, and for your obligations to them regarding their personal information.
4. Acceptable use
The acceptable use policy forms part of these terms.
5. Availability
We aim to keep IGNYX available and accurate, but we do not guarantee it. The service may be unavailable due to maintenance, third-party failures, network conditions or faults. Third-party data sources may change, degrade or stop without notice.
IGNYX is designed to work offline, but offline operation shows the last data received, not current conditions.
6. Your data
You retain ownership of the incident data you create. You grant us the limited licence needed to store, transmit and display it in order to provide the service.
We may use aggregated, de-identified information to improve the product. We will not sell your data.
7. Fees
Paid plans are billed as set out at the time of purchase. Prices exclude VAT unless stated. We will give reasonable notice of price changes.
8. Liability
Read this clause. IGNYX is used in an environment where people can be hurt. It is important that the limits are clear.
To the fullest extent permitted by law, IGNYX is provided as is. We do not warrant that detections are complete or accurate, that projections will match real fire behaviour, or that the service will be available when you need it. We are not liable for loss of life, injury, property damage, loss of profit, or any indirect or consequential loss arising from use of, or inability to use, IGNYX.
Nothing in these terms excludes liability that cannot lawfully be excluded, including under the Consumer Protection Act 68 of 2008 where it applies.
Where liability cannot be excluded, our total liability is limited to the fees you paid us in the twelve months before the claim.
9. Suspension and termination
You may stop using IGNYX at any time. We may suspend or terminate access for a material breach of these terms or the acceptable use policy, and will give notice where it is reasonable to do so.
On termination you may export your incident data for a reasonable period.
10. Changes
We may update these terms. Material changes will be announced on this page with an updated date. Continued use after a change means acceptance.
11. Governing law
These terms are governed by the laws of the Republic of South Africa, and the courts of South Africa have jurisdiction.
